Any violation of the above Aristotle University College of Law Honor Code provisions shall result in disciplinary action. Due process shall be afforded all students accused of Honor Code violations.
Upon receiving notification that a student has violated the Honor Code of the Aristotle University College of Law, the Dean shall appoint a three (3) member Faculty Disciplinary Committee to further investigate and prosecute the matter, conduct a hearing and come to a conclusion as to whether there has been a violation of the Honor Code and what sanction, if any, shall be applied. Students shall be informed in writing of the nature of the charges against them with specificity as to violation. All students will be given a fair opportunity to refute the charges, present evidence, and appeal any adverse decision against them. Disciplinary Sanctions Students found in violation of the Honor Code of the Aristotle University College of Law shall be subject to sanctions as determined to be appropriate through recommendation by the Faculty Disciplinary Committee and approval by the Dean, or the Dean's designee. Possible dispositions of a violation of the Honor Code are inclusive of, but are not limited to:
The Faculty Disciplinary Committee shall inform the student in writing of the Committee’s decision and shall inform the student of their right to appeal the Decision. The letter is to be either personally delivered to the student or sent to the student by either return receipt requested or postal carrier (e.g., Federal Express, DHL, etc.) Appeals Procedures Should a student accused of a violation of the Honor Code desire to appeal the Decision of the the Faculty Disciplinary Committee, the student must give Notice to the Dean of the Aristotle University College of Law within three (3) days of their receipt of the Decision. Upon receiving Notice that a student desires to appeal the Decision of the Faculty Disciplinary Committee, the Dean shall appoint a three (3) member Disciplinary Appeals Committee (which shall not include any of the original three (3) faculty members of the Faculty Disciplinary Committee. Outside members of any Faculty may be used as members of the Disciplinary Appeals Committee; it is not necessary that all three members of the Disciplinary Appeals Committee be law school professors. Generally, attempts will be made to include at least two (2) members of a Faculty and one (1) member of the Administrative Staff of the Aristotle University College of Law in constituting the Disciplinary Appeals Committee. A quorum shall consist of three (3) members of the Disciplinary Appeals Committee. The student shall be notified in writing of the hearing date, time, and procedures at least seven (7) working days prior to the hearing. Hearing Procedures A summary record will be maintained of the Hearing proceedings. The Chairperson of the Disciplinary Appeals Committee will read the charges to the Committee and call on any witnesses the Committee desires. The student will be afforded to present their case, inclusive of witnesses. The student may be questioned by any member of the Disciplinary Appeals Committee. The Chairperson may terminate the student’s right to address the Committee if the student becomes abusive or persists in presenting irrelevant or repetitive evidence or information. Should the accused student fail to appear, the Disciplinary Appeals Committee may rule in absentia. The student may be accompanied by an attorney or non-legal representative. The student or attorney may not examine witnesses or otherwise take part in the proceedings but may freely advise the accused student. The hearing will be closed and members of the Committee will take reasonable precautions to ensure that the proceedings remain confidential, unless disclosure is required by law. Upon the conclusion of the Hearing, the Disciplinary Appeals Committee will deliberate in private and reach an Appeal Decision. The Disciplinary Appeals Committee may acquit the student of the charges, sustain the penalty imposed by the Faculty Disciplinary Committee, or specify new disciplinary action or sanctions to be imposed. The Faculty Disciplinary Committee shall forward their Appeal Decision to the Dean who may either adopt, alter or amend the Appeal Decision and return such Decision to the Faculty Disciplinary Committee for delivery to the accused student. Notification of Appeal Decision The Disciplinary Appeals Committee shall inform the student in writing of the Committee’s decision.
